DMCA Copyright-Infringement Policy

PopTopNews.com is an entertainment news site covering Korean Hallyu (K-pop, K-drama, and related culture). We respect intellectual property and comply with the Digital Millennium Copyright Act (17 U.S.C. § 512). This page explains how to submit a copyright complaint or a counter-notice.

Important: Email is the fastest way to reach us. Physical mail is processed but may take longer.


2) How to Submit a DMCA Takedown Notice

If you believe material on PopTopNews.com infringes your copyright, send a written notice that includes all of the following:

  1. Signature – A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.

  2. Identify the copyrighted work – A description of the work you claim is infringed (title, type of work, publication date, and any unique identifiers).

  3. Location of the allegedly infringing material – The exact URL(s) on PopTopNews.com where the material appears. Please include enough detail to help us locate it quickly (e.g., section, headline, timestamp, or screenshots).

  4. Contact information – Your full name, mailing address, telephone number, and email address.

  5. Good-faith statement – A statement that you have a good-faith belief the use is not authorized by the copyright owner, its agent, or the law.

  6. Accuracy & authority statement – A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner’s behalf.

What we do after receiving a complaint notice

  • Promptly remove or disable access to the identified material;

  • Notify the user or content provider who posted the material;

  • Apply our repeat-infringer policy, which may include restricting or terminating access in appropriate circumstances.

We also accommodate standard technical measures used by copyright owners to identify or protect their works.


3) Counter-Notice (If Your Content Was Removed)

If your content was removed or disabled because of a notice and you believe this was a mistake or misidentification, you may send a counter-notice containing:

  1. Your signature – Physical or electronic.

  2. Identify the removed material – What was removed or disabled, and the precise URL/location where it appeared before removal.

  3. Good-faith statement – A statement that you have a good-faith belief the material was removed or disabled due to a mistake or misidentification.

  4. Contact information – Your full name, mailing address, telephone number, and email address.

  5. Consent to jurisdiction & service – A statement that you consent to the jurisdiction of the U.S. Federal District Court for your judicial district (or, if you are outside the U.S., for the district where we are located) and that you will accept service of process from the person who filed the original notice or their agent.

    • For our location, the relevant court is the United States District Court for the District of Wyoming.

What happens after a valid counter-notice

  • We forward your counter-notice to the original complainant.

  • We will restore the material after at least 10 business days (and typically within a reasonable time thereafter) unless we receive notice that the complainant has filed a court action seeking to restrain the allegedly infringing activity.


4) Repeat-Infringer Policy

We may, in appropriate circumstances, terminate or restrict access for users who are determined to be repeat infringers. We may also remove content at our discretion where we reasonably believe it infringes or violates our Terms.


5) Fair Use, Licensing, and Editorial Context

As an entertainment news outlet, we frequently use images, clips, and quotations for news reporting, commentary, criticism, scholarship, and research, which may qualify as fair use or be covered by a license from rights holders or agencies. If you are unsure whether a use is authorized or fair, please consider this before submitting a notice.

  • If you are a rights-management representative (e.g., label, studio, photo agency), please identify any license conflicts or territorial restrictions in your notice to help us resolve issues quickly.


6) Avoiding Misuse (17 U.S.C. § 512(f))

Knowingly submitting false infringement notices or counter-notices can create liability. Please ensure your claims are accurate and made in good faith.


7) Helpful Tips to Speed Up Review

  • Use a separate email for each distinct work or campaign, when practical.

  • Place one URL per line under “Location of the allegedly infringing material.”

  • Include supporting documentation (e.g., registration certificate, comparison images, license agreements) when available.

  • Use clear subjects: DMCA Notice or DMCA Counter-Notice.
